Know all men by these presents that I,

Nancy Bailey ~ of Shelby County

State of Alabama, relict and widow of

Brittain Bailey late of the Republic of Texas who

died intestate having claims to certain lands

or rights to the same under the laws of said

Republic for direr causes and considerations

me thereunto moving, have made constituted and

appointed and by these presents do make constitute

and appoint and in my place and state put

& depute Nathaniel H. Watrous now of said

Republic my true and lawful Attorney for

me and in my name and for my use to

ask demand recover and receive to obtain

and perfect title to any lands which of right

may belong to said Brittain Bailey from said

Republic ~ to give all deeds, bonds, assurances,

acquitances, receipts or other instruments necessa=

ry to secure or perfect title to any land or lands

to which I may be entitled as widow of said

Brittain Bailey under the laws of said Republic and

the same again to sell and convey and deeds

to the same to make ~ and all other acts and

deeds to do which may be necessary to procure

secure and perfect titles to all lands of every

description which of right may do or might

belong to said Brittain Bailey under said laws of

said Republic or to me as his widow of every

description ~ as full and perfect as I myself

could do were I personally present ~ And I do

hereby authorize my said Attorney to use all

legal means to procure title from said Republic

to all land to which said Brittain had or have

right should have in said Republic as fully

same to sell and convey and all acts to do

in my name and all instruments of writing

to execute for the purpose aforesaid and

Attorney one or more to make and to

revoke ~ hereby satisfying, allowing whatsoever

my said Attorney shall lawfully do in the

pursuance by reason hereof ~ Furthermore I do

hereby authorise the said Nathaniel H. Watrous

and give full & ample power to him to select, locate

get a patent and take possession of all such

land in said Republic belonging to said Brittain

under said laws of said Republic, or to me as his

widow and use the same of his own property

in his own name; alienating & announcing from this

day from myself , my heirs executors and administra

=tors to him the said Nathaniel H. Watrous and

his legal representations, all rights power or

control of the same,

In witness whereof I hereunto set my hand

and seal this 12th day of May One thousand Eight

hundred and thirty eight.

Be it known, that on this 12th
day of May in the year 1838, before me John S. Stone
a Justice of the Peace of said County and Ex-
Officio Notary Public duly sworn, personally
appeared Nancy Bailey whose name is signed to this
above letter of Attorney, who before me & witnesses signed
with his, executed the same as she declares for the
purposes therein mentioned.
Which I hereby certify as authentic, under
my hand and private seal, there being no seal of Office,
this day and year above written ~
